By using the store.flo.ca Web site and/or related transactional pages (the "Web site"), you accept these Terms of Use and Confidentiality Policy, which are subject to change without notice. Furthermore, you agree to consult these Terms of Use and Confidentiality Policy from time to time and acknowledge that your continuing use of the Web site means that you have accepted any changes that may have been made. These General Terms of Use and Confidentiality Policy are a translation of the official French version. In case of inconsistencies, the official French version shall prevail over the English version.

For the purposes hereof, the terms “we,” “us,” and “our” mean the members of Canada’s public network of electric vehicle charging stations known as “FLO" and FLO Services inc., a company located at 2327, boulevard du Versant-Nord, Suite 120, Québec, Québec, G1N 4C2, as the service provider for FLO for the transactional pages of this Web site (the “Transactional Pages”). When any paragraph of these Terms of Use and Confidentiality Policy refers to the “Service Provider,” only FLO Services inc. is contemplated.

We make every effort to ensure that the information on the Web site is reliable when published. Despite our best efforts, we cannot guarantee that the information is accurate or complete, free from error or omission, or that it is up-to-date at all times. We cannot guarantee that the Web site or the FLO charging stations (the “charging stations”) will be accessible at all times, without interruption, or that it will be free from errors. We shall not be held responsible for any damages that may result from the inaccessibility of the Web site or the charging stations, or from any difficulties that you may experience while accessing or using the Web site or the charging stations, including: an interruption of service; a network failure; the malfunction of any equipment, computer hardware or software; or any faulty, incomplete, incomprehensible or deleted transmission, whether or not such difficulties have been brought to our attention. In general and without limiting the specific cases of limitation of liability mentioned above, and notwithstanding any provisions to the contrary, we shall not be held responsible for any damages that may result from or relate to the charging stations, the Web site and/or its contents.

We reserve the right to suspend at any time, without warning, full or partial access to: the Web site, including any of the Transactional Pages and any of our pages accessible through certain social media Web sites. We additionally reserve the right to discontinue uploading information to such sites, in which case we shall not be held responsible for any damages that you may incur. All information on this Web site is subject to change without prior notice.

This Web site contains hyperlinks that may direct you to the Web site of the Service Provider or to the Web sites of our other service providers or third parties. The fact that the Web site offers links to other Web sites does not mean that we endorse or approve the content of these Web sites or the products, services or publications that may appear thereon. The content available through these hyperlinks is not subject to our policies. Therefore, we shall not be held responsible for any damages that you may incur when you are redirected to another Web site by way of a hyperlink.

Transactional Pages

Errors on our Web site

Prices and availability of services are subject to change without notice. Any errors found will be corrected promptly once they have been brought to our attention.

Sales taxes

In accordance with the legislation in force, no sales tax is applied to the prepayment of your account through the Transactional Pages of the FLO Web site. Applicable taxes are included in the rate and will be paid out when you use the FLO charging service.  

Payment

You may use a credit card issued in Canada by Visa®, MasterCard® or American Express® to pay for your transaction.

Confirmation of your transaction

Once your transaction is complete, we will verify the validity of the information you have provided, specifically your method of payment and billing address. We reserve the right to cancel the transaction without providing a reason. If we cancel your transaction, we will notify you by e-mail at the address you have provided.

When we cancel a transaction, we don’t usually charge the amount to your credit card; however, if this should happen, we will refund the amount or ensure that your card is credited for the same amount.

Your use of the Web site

You are prohibited from and agree not to submit on this Web site any information that is inappropriate, obscene, or fraudulent. You are prohibited from and agree not to engage in any activity related to the use of this Web site that constitutes a criminal offence or unlawful action. You agree to indemnify and hold us harmless from all causes of action arising from any of your actions or inactions related to your use of this Web site in violation of this paragraph. We assume no responsibility or liability that may arise from any unlawful content of any user’s submissions or uploads.

IT security

We comply with the applicable law governing the protection of personal information. In addition, the Service Provider uses encryption techniques to guarantee the confidentiality of the information exchanged between you and the Service Provider within Transactional Pages. The Service Provider also protects information exchanged when the Web site is accessed through a non-secure platform or in a public location, which could endanger the confidentiality of your personal information. However, we shall not be held responsible for any damages that you may incur as a result of your access to the Web site under such circumstances.

E-mail communications are neither secure nor confidential. They can be lost or intercepted, in much the same way as communications by other means (for example, by post). No electronic system is completely secure or error-free. We shall not be held responsible for any damages that you may incur from using our Web site or from any exchange of e-mail or electronic messages, whether originating from you or from us.

You alone are responsible for ensuring the protection and safekeeping of your data when using your computer platforms and devices.

Certain names, words, titles, phrases, graphics, logos, icons or designs used on the Web site may be trademarks belonging to the members of FLO, the Service Provider or used with the consent of third-party owners. You agree not to remove, edit or otherwise alter trademarks, service marks, logos and other proprietary information contained on the Web site. Trademarks and the information contained on the Web site, including comments from users, may not be reproduced, in whole or in part, or used in any way without obtaining our prior written consent.

Certain pages of the Web site may be accessible through the following social media Web sites: Facebook, Twitter, YouTube and LinkedIn. Before consulting or using our webpages on these social media Web sites, you must read and comply with their respective terms of use and confidentiality policy.
